Welcome to Riobian Safaris. These Terms and Conditions govern your use of our website and the booking of any travel-related services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.
1. Definitions
- Company refers to Riobian Safaris, located at Kenyatta Avenue, Building: JKUAT Towers, Nairobi, Kenya.
- Service refers to all services provided by Riobian Safaris, including but not limited to safari bookings, transportation, accommodation arrangements, and tour packages.
- Client, You, or Your refers to the person accessing or using the Service.
- Booking means the confirmed purchase of any travel service or safari tour through Riobian Safaris.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Provide accurate, current, and complete information
- Have the legal capacity to enter into a binding contract
3. Booking and Payments
- A non-refundable deposit of 50% is required to confirm any safari booking.
- The remaining balance must be paid no later than 30 days before the travel date.
- Bookings made within 30 days of travel require full payment upfront.
- Payment methods include bank transfers, mobile money (e.g., M-Pesa), or approved card payments.
- All prices are quoted in Kenyan Shillings (KES) or USD unless otherwise stated.
4. Cancellations and Refunds
Riobian Safaris operates a strict no-refund policy.
- All cancellations are subject to the Refund and Returns Policy.
- Clients are encouraged to purchase travel insurance to cover unforeseen circumstances.
5. Changes to Bookings
- Changes requested more than 30 days before the tour may be allowed, subject to availability and administrative fees.
- No changes will be accepted within 30 days of departure.
6. Travel Requirements
- It is the client’s responsibility to obtain valid passports, visas, vaccinations, and other health requirements as needed.
- Riobian Safaris will not be held liable for delays or issues arising from non-compliance with entry regulations.
7. Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our control, including but not limited to:
- Natural disasters
- War or political unrest
- Border closures or pandemics
- Airline or transport disruptions
8. Travel Insurance
All clients are strongly advised to obtain comprehensive travel insurance covering:
- Medical expenses
- Personal accident
- Trip cancellation
- Theft or loss of property
Riobian Safaris will not be held liable for any expenses incurred due to a lack of adequate insurance coverage.
9. Limitation of Liability
Riobian Safaris shall not be liable for:
- Injury, illness, or death during the safari
- Loss or damage to personal property
- Delays or changes in itineraries due to third-party actions or uncontrollable events
Our liability is limited to the amount paid for the tour service.
10. Code of Conduct
You agree to:
- Follow the guidance of your tour guide
- Respect local laws and customs
- Not endanger wildlife, staff, or fellow travelers
- Behave responsibly throughout the trip
We reserve the right to terminate services for any client whose behavior is deemed unsafe, abusive, or disruptive.
11. Intellectual Property
All content on our website, including logos, images, text, and design, is the intellectual property of Riobian Safaris and may not be copied or reused without permission.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya.
Any disputes shall be submitted to the jurisdiction of Kenyan courts.
13. Changes to Terms
Riobian Safaris reserves the right to amend these Terms at any time.
Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of the revised Terms.
